DMCA Policy

Gulskav respects the intellectual property rights of others and expects users of our platform to do the same.   6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Incomplete or inaccurate notices may not receive a response. Submitting a false or misleading notice may expose you to legal liability.

3. Our Response to Valid Notices

Upon receipt of a valid and complete DMCA takedown notice, Gulskav will:

4. Counter-Notification

If you believe that content you posted was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with our copyright agent. A valid counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of a competent court, and that you will accept service of process from the person who provided the original takedown notice or their agent.

Upon receipt of a valid counter-notification, Gulskav will forward it to the original complainant. If the complainant does not initiate a legal action within ten (10) to fourteen (14) business days, we may restore the removed material at our discretion.

5. Repeat Infringer Policy

Gulskav has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. A repeat infringer is any user who has been subject to more than one valid DMCA takedown notice within any twelve-month period, or who has demonstrated a pattern of uploading or sharing content without authorization from rights holders.

We may also terminate accounts of users who submit abusive, bad-faith, or repeatedly incomplete takedown notices.

6. Misrepresentation Warning

Please be aware that under applicable law, including Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material or activity is infringing, or that material was removed by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees incurred by the affected party.

Before filing any notice, please carefully consider whether the use of the material in question constitutes fair use or another permissible use. We strongly encourage consulting a qualified legal professional if you are uncertain.

7. Good Faith and Fair Use

Gulskav acknowledges that not all copying or use of copyrighted works constitutes infringement. Some uses may qualify as fair use, transformative use, commentary, education, or criticism. When evaluating a DMCA notice, we may take into consideration whether such defenses appear applicable. However, we are not in a position to make legal determinations on behalf of any party and will generally defer to valid notices while allowing the counter-notification process to resolve disputes.

8. Third-Party Content

Our platform may contain links to third-party websites or embedded content from external sources. Gulskav does not control, monitor, or take responsibility for the copyright practices of third-party websites. If you believe infringing content exists on a third-party site linked from our platform, you should contact that site directly with your copyright concerns.

9. Modifications to This Policy

Gulskav reserves the right to update or modify this DMCA Policy at any time without prior notice. Changes will become effective upon posting the revised policy to this page with an updated date. Continued use of our platform following any such update constitutes your acceptance of the revised policy.
